Advocate or attorney?

Parents can do this alone, but many get help. They offer different kinds of help.

Advocates

Advocates know the special education system, help with records and meetings, and can help a family stay organized. They're not lawyers and can't give legal advice.

Attorneys

Attorneys can file complaints, negotiate settlements and represent you at a hearing. Under federal law, a parent who prevails may be able to recover reasonable attorney's fees from the school district, which is why many special education attorneys take these cases without charging the family up front. Ask each attorney how they're paid.
