The impartial hearing

If the case doesn't settle, an impartial hearing officer hears it and makes a decision.

Who is there

The hearing officer, the parent (and their advocate or attorney if they have one), and a representative of the DOE. Witnesses may testify. Many hearings now take place by video.

Evidence

Both sides submit documents, usually IEPs, records and service logs. This is where your timeline matters.

The decision

The officer issues a written decision, the findings of fact and decision. If compensatory services are awarded, it says what kind, how many hours, and often by when they must be used. Either side may be able to appeal to a State Review Officer.
